At the National Conference of Presidents of Higher People’s Courts held on the 8th, the Supreme People’s Court emphasized the need to apply the law accurately, vigorously promote the core socialist values and the spirit of socialist rule of law, respect the people’s simple yet profound sense of fairness and justice, and safeguard social equity and justice through strict and impartial administration of justice.

　　The meeting called on courts at all levels to firmly uphold sound principles of criminal justice, and to punish crime and protect the people more effectively and precisely. It emphasized the need to strictly enforce the Criminal Law, the Criminal Procedure Law, and relevant judicial interpretations; to accurately implement the criminal policy of combining leniency with severity; and to unswervingly carry out the Party and the state’s death penalty policy, ensuring that the death penalty is applied only to a very small number of offenders who have committed extremely serious crimes and for whom the evidence is conclusive and sufficient.

　　It is reported that in 2023, courts at all levels will crack down rigorously on crimes involving infiltration, subversion, sabotage, violence and terrorism, ethnic separatism, and religious extremism; severely punish serious violent offenses such as homicide, robbery, and gun- and explosives-related crimes; institutionalize efforts to eliminate organized crime and evil forces; and, in accordance with the law, impose strict penalties on major accidents caused by negligence, offenses endangering food and drug safety, telecom and cyber fraud, and violations of citizens’ personal information—crimes that have drawn strong public concern—thereby ensuring the people’s peace and prosperity.

　　Meanwhile, courts at all levels will make full use of the relevant provisions on the extraterritorial application of law to appropriately address cross-border asset restructuring, insider trading, market manipulation, illegal cross-border operations in the securities market, money laundering, and other criminal offenses that violate China’s Criminal Law, and to advance the handling of major cases.

　　With regard to strengthening judicial safeguards for human rights, courts at all levels will strictly adhere to the standards of proof, uphold the principles of legality, evidence-based adjudication, and presumption of innocence, and rigorously scrutinize the facts, evidence, procedures, and legal application in each case. They will fully ensure that defendants and their defense counsel can exercise their procedural rights in accordance with the law, improve and implement systems for victim assistance, and respect and protect lawyers in the lawful performance of their duties. Moreover, they will remain committed to seeking truth from facts and correcting any errors, continuously refining mechanisms for preventing, rectifying, and holding accountable for wrongful convictions.
