On October 26, the General Office of the Ministry of Agriculture and Rural Affairs, in its reply to the Jiangxi Provincial Department of Agriculture and Rural Affairs regarding the “Request for Clarification on Whether Bird-Repellent Agents Are Classified as Pesticides,” stated the following:

According to Article 2 of the Regulations on the Administration of Pesticides, any substance—whether chemically synthesized or derived from biological or other natural sources—or any mixture thereof, together with its formulations, used to prevent or control diseases, pests, weeds, rodents, and other harmful organisms that threaten agriculture and forestry, is classified as a pesticide. Accordingly, chemical substances or mixtures of such substances—whether synthetically produced or of biological or other natural origin—intended for agricultural use and primarily functioning to repel birds, are also considered pesticides. The bird‑repellent products mentioned in your letter, whose labels indicate they are intended to protect seeds, seedlings, and fruits from damage by birds, rodents, and poultry, and which are applied via spraying, seed treatment, or broadcasting in the cultivation of crops such as rice and wheat, should be designated as pesticides and managed in accordance with the relevant provisions of the Regulations on the Administration of Pesticides.
