On October 26, the General Office of the Ministry of Agriculture and Rural Affairs, in its reply to the Jiangxi Provincial Department of Agriculture and Rural Affairs regarding the “Request for Clarification on Whether Bird-Repellent Agents Qualify as Pesticides,” stated the following:

According to Article 2 of the Regulations on the Administration of Pesticides, any substance or mixture of substances—whether chemically synthesized or derived from biological or other natural sources—that is used to prevent or control diseases, pests, weeds, rodents, and other harmful organisms affecting agriculture and forestry is classified as a pesticide. Accordingly, chemical‑synthesized or biologically‑derived substances, or mixtures thereof, intended for agricultural production and primarily functioning to repel birds, are also considered pesticides. The bird‑repellent products mentioned in your letter, whose labels indicate use for preventing birds, rodents, and rabbits from feeding on seeds, seedlings, and fruits, and which are applied via spraying, seed dressing, or broadcasting in the cultivation of crops such as rice and wheat, should be designated as pesticides and managed in accordance with the relevant provisions of the Regulations on the Administration of Pesticides.
