Recently, several pesticide companies have reported to the Neonicotinoid Products Working Group of the China Pesticide Industry Association that a number of enterprises are illegally producing and selling imidacloprid technical grade and acetamiprid technical grade without the requisite licenses, thereby severely disrupting the normal market order and causing extremely adverse consequences.

To ensure the legality of relevant production activities, foster a fair and equitable competitive environment, and safeguard the healthy and orderly development of the agrochemical industry, the members of the collaborative group will join forces to submit their concerns to government authorities and pursue legal action. Hereby, we issue the following solemn warning:

I. Enterprises that have illegally produced imidacloprid technical grade and acetamiprid technical grade without obtaining a production license must immediately cease production and sales.

II. With respect to enterprises that have previously engaged in the illegal production of imidacloprid technical grade and acetamiprid technical grade, the Coordination Group and its member units reserve the right to hold them accountable for their unlawful conduct.

III. Enterprises that, despite repeated warnings, continue to illegally produce imidacloprid technical grade and acetamiprid technical grade shall be promptly reported to the relevant regulatory authorities; depending on their subsequent conduct, they shall be held legally accountable in accordance with the law.

Article 52 of the Regulations on the Administration of Pesticide Registration:

Anyone who produces pesticides without a pesticide production license or produces counterfeit pesticides shall, upon order of the agricultural administrative department of the people’s government at or above the county level, be required to cease production; any illegal gains, illegally produced products, and tools, equipment, raw materials, and other items used in the illegal production shall be confiscated. If the value of the illegally produced products is less than RMB 10,000, a fine of no less than RMB 50,000 but no more than RMB 100,000 shall be imposed; if the value exceeds RMB 10,000, a fine of not less than ten times but not more than twenty times the value of the products shall be imposed. The licensing authority shall revoke the pesticide production license and the corresponding pesticide registration certificate. Where the conduct constitutes a crime, criminal liability shall be pursued in accordance with the law.
