Ministry of Agriculture and Rural Affairs: Notice on Standardizing Matters Such as the Change of Pesticide Registration Certificate Holders

| To the Departments (Commissions, Bureaus) of Agriculture and Rural Affairs (Agriculture and Animal Husbandry) of all provinces, autonomous regions, and municipalities directly under the central government, and to the Bureau of Agriculture and Rural Affairs of the Xinjiang Production and Construction Corps:
To implement the State Council’s “delegation, regulation, and service” reform requirements, standardize the application and processing of matters such as changes to pesticide registration certificate holders, and enhance service efficiency to better serve businesses and the public, effective November 1, 2019, applications for changes to pesticide registration certificate holders and related matters will be accepted at the Ministry of Agriculture and Rural Affairs’ Administrative Service Hall. The relevant details are hereby notified as follows:
I. Application Process
(1) Applicants shall log in to the China Pesticide Information Network, click on the “Digital Platform” section, and submit their applications online at http://www.chinapesticide.org.cn. Alternatively, they may mail the required documents to the Pesticide Service Window of the Ministry of Agriculture and Rural Affairs’ Administrative Service Hall, or visit the service window in person to submit their applications and supporting materials.
(2) The Pesticide Service Window of the Administrative Service Hall of the Ministry of Agriculture and Rural Affairs shall review the applications and supporting documents submitted by applicants. If the materials are complete and conform to the statutory requirements, the application shall be accepted.
(3) The Pesticide Inspection Institute of the Ministry of Agriculture and Rural Affairs conducts a technical review.
(4) The Pesticide Management Division of the Ministry of Agriculture and Rural Affairs shall review the application; if it meets the requirements, the application shall be processed; if it does not meet the requirements, the applicant shall be notified in writing with an explanation of the reasons.
II. Documentation Requirements
(1) Change of the pesticide registration certificate holder. Situations in which the holder of a pesticide registration certificate may change include: a change of name or relocation of the enterprise’s registered address; the dissolution of an acquired enterprise, or the acquired enterprise’s decision to discontinue pesticide production, with the entire registration certificate transferred to the acquiring entity; and a change of registration certificate among pesticide-producing subsidiaries within a group in which the parent company holds more than 51% of the shares. The following documents shall be submitted: an application form; a copy of the production license of the new certificate holder; an opinion from the provincial agricultural and rural affairs authority approving the change; relevant documentation proving equity ownership; a report (or certification) from the original certificate holder consenting to the change or relinquishing the production of the pesticide product; the original pesticide registration certificate; and the original label, among other required materials.
(2) Reissuance of pesticide registration certificates or labels. The application form and relevant supporting documents shall be submitted.
(3) Amendment of pesticide registration certificates or labels. The application form, relevant supporting documents, and the original registration certificate or label shall be submitted.
(4) Addition of information to the pesticide registration database. Information to be added includes: a new applicant name, a new active ingredient, a new dosage form, a new crop, and a new target pest or disease. The following documents shall be submitted: the application form and relevant supporting materials.
(5) Changes to the information on the certificate of non‑pesticide registration testing institution. This primarily includes changes to key personnel and updates to the unit’s contact person and contact information. The following documents must be submitted: an application form, updated information on personnel and contact details, a list of pesticide registration trials affected by the personnel changes, and the consent of the provincial agricultural and rural affairs authority regarding the changes, among others.
(6) Reissuance of the Certificate for Pesticide Registration Test Institutions. The application form and relevant supporting documents shall be submitted.
III. Processing Timeframe
Within three months from the date of acceptance at the Administrative Service Hall of the Ministry of Agriculture and Rural Affairs, an approval decision shall be made.
IV. Other Requirements
(1) Each provincial pesticide regulatory authority shall carry out publicity within its jurisdiction and provide guidance to applicants in handling relevant matters in accordance with the applicable requirements.
