    The Measures for the Designation of Key Monitoring Sites in Hebei Province’s Chemical Industry Have Been Issued.

     Recently, the General Office of the People’s Government of Hebei Province issued the Measures for the Identification of Key Monitoring Sites in the Chemical Industry of Hebei Province, as follows:

      Measures for the Designation of Key Monitoring Sites in the Chemical Industry of Hebei Province
      Article 1: In order to implement the state’s policies on promoting high-quality development in the chemical industry and the relevant requirements set forth in the “Hebei Province Work Plan for Advancing the ‘Four Batches’ Initiative among Industrial Enterprises” (Document No. 185 [2020] of the Hebei Provincial Government General Office), this Measures is hereby formulated to standardize the management of the chemical industry, enhance the intrinsic safety and green development levels of key chemical enterprises, and facilitate enterprise transformation, upgrading, quality improvement, and efficiency enhancement, taking into account the actual conditions of our province.
      Article 2: For the purposes of these Measures, “key chemical monitoring sites” (hereinafter referred to as “key monitoring sites”) refer to chemical production enterprises that, while located outside professionally designated chemical industrial parks or chemical concentration zones recognized in accordance with the “Hebei Province Measures for the Recognition of Chemical Industrial Parks (Trial)”, comply with national industrial policies and management standards, possess advanced technological levels, operate at a substantial scale, implement comprehensive safety and environmental protection measures, and demonstrate outstanding economic performance.
      Article 3: Municipal and county governments shall be responsible for the supervision and management of key monitoring sites. Relevant provincial departments, in accordance with their respective duties, shall carry out oversight, provide guidance, and offer support, thereby continuously enhancing the quality, efficiency, intrinsic safety, and green development of enterprises at these key monitoring sites.
      Article 4: Enterprises designated as key monitoring sites shall, with respect to project approval, construction, and management, be subject to the same regulations applied to enterprises within chemical industrial parks.
      Support enterprises in, in accordance with relevant regulations on the construction and management of chemical projects, legally and compliantly undertaking new construction, renovation, or expansion of existing equipment‑related products and upstream and downstream projects within or immediately adjacent to their plant premises.
      Article 5: Independent legal entities that are controlled by enterprises designated as key monitoring sites and are contiguous with the production facilities of such key monitoring sites may, subject to compliance with safety and environmental protection requirements, be brought within the scope of monitoring for the relevant key monitoring‑site enterprises.
      Enterprises that are included in the key monitoring list may, in accordance with applicable laws and regulations, carry out renovation and expansion of their existing production facilities and products within their own premises.
      Article 6: A site shall be designated as a key monitoring point only if it simultaneously meets the following conditions:
      (1) The industrial site is contiguous and compact, in compliance with the local land‑use and spatial planning (urban–rural planning and overall land‑use plan). (2) The distance between the enterprise’s production and storage facilities and sensitive locations such as schools, hospitals, and residential areas complies with applicable requirements for external safety and atmospheric environmental protection distances. (3) The enterprise’s products, process technologies, equipment, and production scale conform to the current national “Guidance Catalogue for Industrial Structure Adjustment,” the “Foreign Investment Industry Guidance Catalogue,” and relevant industrial policies at the national, provincial, and municipal levels. (4) For basic chemical producers, the average main business revenue for the previous year or the past three years must be no less than RMB 1 billion, with tax contributions of no less than RMB 50 million; for fine chemical and new‑material chemical producers, the average main business revenue for the previous year or the past three years must be no less than RMB 100 million, with tax contributions of no less than RMB 50 million. High‑tech enterprises, agrochemical producers, resource‑comprehensive utilization enterprises, export‑oriented enterprises, and enterprises undertaking national or provincial capacity‑reduction tasks may, at the discretion of each city and based on local conditions, appropriately lower these thresholds. (5) The enterprise maintains comprehensive environmental and safety facilities, including a centralized safety and environmental monitoring and surveillance system that covers all major hazard sources and discharge outlets. Wastewater and exhaust gases are discharged in compliance with standards, hazardous waste is rendered harmless and disposed of at a 100% treatment rate, and hazardous waste storage meets relevant safety and environmental protection requirements. (6) The enterprise is equipped with management personnel adequate to ensure safe and environmentally sound operations, as well as fire‑fighting facilities and personnel meeting occupational safety and emergency response requirements, and possesses effective capabilities in safety, environmental protection, and emergency management. Enterprises that have achieved Level 3 or higher in workplace safety standardization and have passed clean‑production audits may be deemed to possess equivalent effective management capacities in safety, environmental protection, and emergency response. (7) During the current year, the enterprise has not been subject to national or provincial oversight or publicized supervision, nor does it have any outstanding items requiring time‑limited rectification related to safety, environmental protection, or fire safety. Over the past three years, no major or above production safety incidents or environmental pollution incidents have occurred, and there are no issues involving illegal land use or unauthorized water extraction.
      Article 7: Key monitoring sites shall be designated and publicly announced by the governments of each city (including Dingzhou and Xinji City; the same shall apply hereinafter), with copies of the list forwarded to the Provincial Development and Reform Commission, the Provincial Department of Industry and Information Technology, the Provincial Department of Ecology and Environment, the Provincial Department of Natural Resources, and the Provincial Emergency Management Department.
      Article 8: Each municipal government shall formulate procedures for identifying and managing key monitoring sites within its jurisdiction, and may, in light of local conditions, establish more stringent criteria for such designation. Key monitoring sites experiencing operational losses or declining economic performance shall be designated as priority targets for safety and environmental oversight.
      Article 9: Each municipal government shall establish an exit mechanism for key monitoring sites. Where any of the following circumstances occur, the site shall be ordered to make rectifications within a specified time limit; if the rectification remains non‑compliant, the qualification as a key monitoring site shall be revoked:
      (1) Projects that have been illegally newly constructed, reconstructed, or expanded;
      (2) Where a major or more serious production safety accident or an environmental emergency has occurred; (3) Where there are acts of tampering with or falsifying monitoring data, or other behaviors aimed at evading regulatory oversight; (4) Where other serious violations of laws or regulations have been found.
      Article 10: Priority monitoring sites are encouraged to develop within chemical industrial parks, thereby strengthening the parks’ industrial value chains, optimizing their industrial ecosystems, and driving improvements in the overall quality of park development.
      Article 11: The provincial and municipal departments of industry and information technology shall take the lead in establishing an information‑sharing mechanism and, on a regular basis, report to the relevant authorities on the production and operations, project construction, and safety and environmental protection conditions at key monitoring sites.
      Article 12: These Measures shall enter into force as of the date of their promulgation, and the interpretation thereof shall be undertaken by the Provincial Department of Industry and Information Technology in conjunction with the relevant provincial departments.
