A common question posed by pesticide companies is: “For products we plan to register domestically, some of the required tests have already been completed—albeit at foreign laboratories. Can such test reports be accepted?” Article 16 of the Measures for the Administration of Pesticide Registration stipulates that registration test reports must be issued by testing institutions accredited by the Ministry of Agriculture, or by relevant overseas laboratories that have signed mutual recognition agreements with the competent authorities of the Chinese government. However, tests related to efficacy, residue, environmental impact, and other factors closely tied to environmental conditions, as well as registration tests involving biological species unique to China, must be conducted within China. In light of this provision, this article reviews Case No. 2569.

In response to this provision, this article reviews the explicit stipulation in Announcement No. 2569 that “tests must be conducted within the territory of China,” with the hope that readers will find a satisfactory answer therein.
