The Ministry of Agriculture and Rural Affairs has amended four regulations pertaining to pesticide management.

On December 6, 2018, Minister of Agriculture and Rural Affairs Han Changfu signed Ministry Order No. 2 of 2018, promulgating the “Decision of the Ministry of Agriculture and Rural Affairs on Amending Certain Regulations” (hereinafter referred to as the “Decision”), which took effect from the date of its publication. The Decision states that, in order to implement the spirit of the national videoconference on deepening the “delegation, regulation, and service” reform and transforming government functions, as well as the requirements set forth in the State Council’s Guiding Opinions on Accelerating the Development of a Nationally Integrated Online Government Services Platform (Document No. 27 [2018] of the State Council), the Ministry of Agriculture and Rural Affairs has conducted a comprehensive review and revision of regulations that are no longer aligned with the “one-stop online service” model for government affairs.

The Decision states that, in order to implement the spirit of the national videoconference on deepening the “delegation, regulation, and service” reform and transforming government functions, as well as the requirements set forth in the State Council’s Guiding Opinions on Accelerating the Development of a Nationally Integrated Online Government Services Platform (Document No. 27 [2018] of the State Council), the Ministry of Agriculture and Rural Affairs has conducted a comprehensive review of regulations that are incompatible with the “one-stop online” approach to government services. Following this review, the Ministry has decided to amend certain provisions of five regulations, four of which pertain to pesticide management.

1. Article 12 of the Measures for the Administration of Pesticide Registration (Ministry of Agriculture Order No. 3 of 2017) is amended to read: “The applicant shall submit the relevant materials as prescribed and shall be responsible for the authenticity and legality of the information provided.” (The original provision stated: “ The applicant shall submit both paper documents and electronic files, and shall be responsible for the authenticity and legality of the materials provided. .”)

2. Delete paragraph 2 of Article 9 of the Measures for the Administration of Pesticide Production Licenses (Ministry of Agriculture Order No. 4 of 2017), which originally provided: “ Applicants for a pesticide production license shall submit the following materials to the provincial agricultural authority at the place of production: … (2) A copy of the enterprise’s business license. ;”).

That is Enterprises applying for a pesticide production license are not required to submit a copy of their business license to the provincial agricultural authority at the place of production. 。

3. Delete paragraph 2 of Article 8 of the Measures for the Administration of Pesticide Business Licenses (Ministry of Agriculture Order No. 5 of 2017), which originally provided: “ Applicants for a pesticide business license shall submit the following materials to the local agricultural authority at or above the county level: … (2) A copy of the legal representative’s (or person in charge’s) identity document; ”).

Specifically, operators applying for a pesticide business license are not required to submit a copy of the legal representative’s (or person in charge’s) identity document to the local agricultural authorities at or above the county level.

4. Delete paragraph 2 of Article 6 of the Measures for the Administration of Pesticide Registration Trials (Ministry of Agriculture Order No. 6 of 2017), which originally provided: “ An institution applying to undertake pesticide registration trials shall submit the following documents to the Ministry of Agriculture: … (2) A copy of its legal person qualification certificate, or a letter of authorization from the legal person;” and Article 17, Paragraph 2 (formerly stipulated as follows: “Those conducting registration trials for new pesticides shall submit an application to the Ministry of Agriculture and provide the following materials: … (2) Information on domestic and international research and development, as well as overseas registration status.” ;”).

Specifically, institutions applying to conduct pesticide registration trials are not required to submit a copy of their legal entity qualification certificate or a letter of authorization from the legal entity. For those conducting registration trials for new pesticides, no documentation regarding domestic and international research and development activities or overseas registration status is required at the time of application to the Ministry of Agriculture.
