Thiamethoxam has once again been approved for sale, use, production, and import in Brazil.

The First Court of the Federal District of Brazil has ruled to lift the restrictions on the sale, use, production, or import of agricultural chemical products containing thiamethoxam within Brazilian territory. This decision overturns the February announcement issued by the Brazilian Institute of Environment and Renewable Natural Resources (Ibama) that had imposed such restrictions. The Federal District Court’s ruling accepted the technical and legal arguments submitted by Brazil’s Ministry of Agriculture, Livestock, and Supply (Mapa).

Effective from the date of this decision, products containing thiamethoxam may be marketed and are recommended for continued use in accordance with the label instructions. Thiamethoxam is a second‑generation neonicotinoid insecticide, classified as Toxicity Category III (moderately toxic), and is approved for use on a wide range of crops. Daniela Rézio, Vegetable Health Manager at the Crop Protection Bureau, stated that this new decision is highly significant, with far‑reaching implications for retailers, growers, industry professionals, and society at large. She emphasized the importance of ensuring that technical personnel apply the product correctly and safely, thereby supporting agricultural production, food security, and environmental protection.

The Pesticide Law stipulates that thiamethoxam may only be suspended by MAPA, the agency responsible for pesticide registration and re‑evaluation. According to the court ruling, in order to restrict the use of a registered product, the Ministry of Agriculture is required to develop an alternative plant disease‑control plan.

Following the issuance of the new resolution, distributors, cooperatives, and retailers have once again been authorized to commercialize products containing thiamethoxam, in accordance with the recommended guidelines, and Brazilian farmers may continue to use such products under the guidance of technical personnel, adhering to label instructions and recommendations.

Rodrigo Baiocchi, Coordinator for Pesticides and Biological Inputs in the Vegetable Health Management Division of the Crop Protection Agency, emphasized: “Although the use of this active ingredient is permitted, growers must apply it in accordance with the recommendations of duly registered professionals from the Regional Councils of Engineering and Agronomy.” This approach helps prevent the risk of overdosing, which can be highly detrimental to pollinating insects, farmers themselves, and society at large.
